A Vancouver-based bakery has been fined $55,000 after a worker at its Mississauga shop was injured on the job.
The Ontario Ministry of Labour said in a news release on Friday that NuStef Baking Ltd. pleaded guilty in Provincial Offences Court in Mississauga on July 29 to an offence under the Occupational Health and Safety Act
The incident occurred on March 20, 2023 when an employee of the bakery shop on Cawthra Road in Mississauga was hurt while adjusting the speed of a batter depositor on an industrial oven while it was operating.
“To do this, they reached below the oven to manually turn a knob while the batter depositor was in motion and suffered serious injuries as a result,” the ministry’s news release stated, adding that by not ensuring the equipment was properly guarded, NuStef Baking Ltd. failed to adhere to a specific regulation of the Occupational Health and Safety Act.
According to the ministry, its investigation determined that “although the method the worker used to change the speed was consistent with both their on-the-job training and the manufacturer’s instructions, the industrial oven was not properly guarded.”
In addition to the $55,000 fine imposed by a Justice of the Peace, the court also imposed a 25 per cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to help victims of crime.
